Boeing’s News Max Tax Strikes Again

Akasa Air is reportedly in talks with Boeing for more than 200 additional 737 MAX jets, according to Bloomberg — a deal that roughly doubles the Indian carrier's existing order book. It comes as Boeing is separately dealing with a software problem on the MAX that, this week, led two of Boeing's biggest US customers to start turning airplanes away. The two stories aren't officially connected. But put next to each other, they raise the same question that's dogged Boeing's single-aisle program for most of this year: can the company actually build and deliver what it's selling? What Boeing Disclosed The Wall Street Journal reported on September 26 that Boeing flagged a software issue in the 737 MAX's flight management computer. The problem surfaces in a specific scenario: during a go-around or another abrupt change in flight path — the kind of maneuver a pilot executes on a missed approach — the affected software can drop vertical navigation (VNAV) guidance. The FMC doesn't fail outright, and pilots retain manual control, but losing automated vertical guidance at exactly the moment a crew is already task-saturated, close to the ground, and re-establishing a flight path is not a nothing-problem. The issue is reported to affect only the newest FMC software build — described in reporting as U14 or U14.1 — meaning it's a forward-looking delivery problem more than a fleet-wide grounding risk. Older aircraft running earlier software builds aren't implicated. But new-build aircraft coming off the line now are. Southwest and United are both reported to have told Boeing they won't accept new MAX deliveries running the affected software. An FAA Corrective Action Review Board has convened, which is the formal mechanism the agency uses when it wants a documented, auditable fix rather than an informal patch — a signal this is being treated as a real finding. What's not yet established publicly: how long the fix takes, whether it touches only new production or requires action on aircraft already delivered, and whether it has any bearing on 737 MAX 7 delivery timing or 737 MAX 10 certification, both of which remain open questions Boeing hasn't addressed on the record. Where the Deliveries Come In This matters because 2026 was supposed to be the year Boeing's MAX delivery rate stopped being an excuse. The company has spent the year working through engine, casting, and fuselage supply constraints, slowly climbing production and delivery numbers back toward pre-2024 levels. A software issue that causes two major US carriers to refuse new-build aircraft is a different kind of problem than a parts shortage — it's not a supply-chain bottleneck, it's a quality-control and certification bottleneck, and those tend to resolve faster once identified, precisely because nothing physical needs to be re-sourced. A software fix and a re-flash is, in principle, a matter of weeks, not the months or years a casting supplier constraint takes to unwind. Those are different sentences, and conflating them overstates the case. Akasa's Order, in Context Akasa is a relevant carrier to watch regardless of the software issue, because its relationship with Boeing has already been strained by delivery timing once this year. The airline has 226 MAX aircraft on order, with 43 currently in its operating fleet — meaning roughly 183 aircraft are still unfilled backlog. Reuters reported in March that delivery delays had left Akasa with around 310 pilots sitting idle, trained and ready for aircraft that hadn't arrived — a direct, quantified cost of Boeing's delivery shortfalls landing on one specific customer's P&L and workforce planning. Akasa has also been reported to be weighing India's emergency credit guarantee scheme, a mechanism designed to help carriers bridge financing gaps — itself a signal that the airline's growth plan is running on a tighter margin than 226 aircraft on order might suggest from the outside. Against that backdrop, a deal for 200-plus more MAX jets reads two ways. It's a vote of confidence — Akasa doubling down on Boeing rather than diversifying to Airbus, at a moment when plenty of the world's growth-market carriers are doing exactly the opposite. And it's a bet that Boeing's delivery execution, which has already cost Akasa idle pilots and payroll this year, gets meaningfully better from here — a bet placed the same week Boeing disclosed a new software defect serious enough that Southwest and United are refusing aircraft. A Different Kind of Constraint It would be a mistake to fold this software issue into the same "Boeing's backlog keeps growing and its ability to deliver is once again constrained" narrative that's applied all year to engines, fuselage panels, and castings. The supply chain story and the software story are not the same risk, and treating them as interchangeable overstates what's actually been reported so far. There is no evidence yet that the FMC issue is slowing total delivery volume — only that two customers are declining to accept specific new-build aircraft until Boeing resolves it. Whether that becomes a broader hold, and whether it touches the 737 MAX 7 or 737 MAX 10 programs at all, is unconfirmed. What is fair to say: Boeing entered this new MAX order conversation with Akasa carrying a live, unresolved quality issue on the same production line those future aircraft would come off. That's a fact worth knowing before treating a 200-plus-jet order as pure good news for Boeing's backlog. Bottom Line Akasa's talks with Boeing for over 200 more MAX jets would be one of the largest single vote-of-confidence orders Boeing has landed all year — from a customer that has already absorbed real costs, in idle pilots and stalled growth, from Boeing's inability to deliver on time. The two facts don't prove Boeing's delivery problems are back — a software defect is a fundamentally different, generally faster-to-resolve problem than a supply-chain shortage.
